It's something rarely considered: If a person is too drunk to drive, aren't they also too drunk to notice someone else might be too drunk to drive for them? It's a question Todd Birch should have pondered. On leaving an Indianapolis bar, Birch realized he was in no shape get behind the wheel. He gave his keys to his girlfriend, Liza Besser. Of course, Besser had been at the same bar, drinking along with Birch. Besser got into the car, started it, and had intended to pull up to where she'd left Birch to pick him up.

"Next thing she knows," explained Indianapolis Police Sgt. William Weber, "she feels this lump or bump." And then she couldn't see her boyfriend anywhere - until she checked under the car. It's assumed Birch wandered off the sidewalk and into Besser's path. Birch was declared dead at the scene. Besser was arrested on preliminary charges of driving while intoxicated, causing a death.
